This Privacy Policy describes how HR Neeti Private Limited (“HR Neeti”, “we”; “us”; “our”) collects, uses, maintains and discloses information collected from users (each, a "User") of the Website and cloud based platform 𝗛𝗥 𝗡𝗲𝗲𝘁𝗶 𝗖𝗹𝗼𝘂𝗱 𝗛𝗖𝗠 (“Platform”). This privacy policy applies to the Site and all products and services offered by us.

It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing information about you, so that you are fully aware of how and why we are using your information. This Privacy Policy is governed by and is compliant with the relevant provisions of the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 which are designed to protect the Personal Information; and other applicable rules and regulations related to privacy and the Information Technology (Intermediaries Guidelines) Rules, 2011, pertaining to exercise of due diligence by the intermediary.

 

3. Types and Purpose of Personally Identifiable Information We Collect

Personally identifiable information (or personal data) means any information about an individual from which that person can be identified. It does not include personal information where the identity has been removed (anonymous personal information).  

We collect, use, store and transfer the following personal information about you:

Employee Information	We collect following details of the customer’s employees’: Date of birth, address, contact numbers, contact address  Details of family members, their ages (for nomination) Photograph Qualifications, Skills, Experience Loans and advances, insurance details Compensation details, bank accounts, TDS data Adhar, PAN, UAN, ESIC numbers for maintaining in the system for efficient access and analysis by the Customer and customer’s employee
Employee’s Employment related Information	We collect following details of the customer’s employees’: Interview ratings, probation reviews; Leave / OD, movement tracking; Performance, Appraisals and feedbacks; Disciplinary actions; Promotions/ transfers; for efficient access and analysis by the Customer and customer’s employee

 

4. Non-Personal Identification Information

We may collect non-personal identification information about Users whenever they interact with our Site or Platform. Non-personal identification information may include the browser name, your usage and log related information, the type of electronic device, manufacturer, make, model, unique ID of the electronic device and other technical information about User’s means of connection to our Platform, such as the operating system and the Internet service providers utilized and other similar information. For example, we may use IP addresses to monitor the regions from which User navigates our Platform. User understands that this information shall be non-personal information and could be used by HR Neeti, for its own business purposes.

We will collect personal information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

The User undertakes that it shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information shared by each User through the Platform whether of its own or any third party. In the event the User is sharing any Personal Information on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Information with HR Neeti, obtained a written consent from such third party and HR Neeti shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Information shall be subject to the terms and conditions of this Privacy Policy.

In addition to the information that we collect from you directly, we may also receive information about you from other sources, including third parties, business partners, our affiliates, or publicly available sources which helps us deliver services under a formal contract or propose services to you.

• We may use information in the aggregate to understand how our Users as a group use the Services and resources provided on our Website.

Only authorized HR Neeti personnel who have signed up on the internal employee confidentiality agreements are provided access to customer’s employee’s personally-identifiable information, and these authorized HR Neeti employees are required to treat this information as confidential. 

Despite these precautions, due to the open and secured and unsecured nature of connections on the Internet on this portal, HR Neeti cannot guarantee that unauthorized persons will not/cannot obtain access to your personally identifiable information collected by HR Neeti. Data pilferage due to unauthorized access, hacking, virus attacks, technical issues, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss is possible, and we take no liability or responsibility for it. HR Neeti’s operations run on the Secure Encrypted Cloud for its customers with the highest levels of security, encryption, anonymization and other processes where required  to make it absolutely secure for critical customer operations 24×7.

 

7. We Use Cookies for the Following Purposes:

• HR Neeti may be required to disclose User’s Personal Information due to legal or regulatory requirements. In such instances, we reserve the right to disclose User’s Personal Information as required in order to comply with our legal obligations, including but not limited to complying with court orders, warrants, or discovery requests. We may also disclose User’s Personal Information to: (a) law enforcement officers or others; (b) to comply with a judicial proceeding, court order, or legal process served on us or the Software; (c) to enforce or apply this Privacy Policy or our other policies or agreements; (d) for an insolvency proceeding involving all or part of the business or asset to which the information pertains; (e) respond to claims that any Personal Information violates the rights of third-parties; (f) or protect the rights, property, or personal safety of the Company, or the general public. User agrees and acknowledges that we may not inform User prior to or after disclosures made according to this section.
• HR Neeti may share User’s Personal Information to third party service providers, who are working with us in connection with the operation of the Services or the Platform, so long as such service providers are subject to confidentiality restrictions consistent with this Privacy Policy.
• HR Neeti may disclose your personally-identifiable information if, in connection with submitting the information, you consent to such disclosure, and,
• HR Neeti may disclose your personally-identifiable information Regulators and other authorities acting as processors or joint controllers who require reporting of processing activities in certain circumstances;
• HR Neeti may disclose your personally-identifiable information professional advisers acting as processors or joint controllers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services;
• HR Neeti may disclose your personally-identifiable information service providers acting as processors who provide technology, fraud prevention, and system administration support services.
• Where permitted by law, HR Neeti may share User’s Personal Information with joint marketers with whom we have a marketing arrangement, we would require all such joint marketers to have written contracts with us that specify appropriate use of User’s Personal Information, require them to safeguard User’s Personal Information, and prohibit them from making unauthorized or unlawful use of User’s Personal Information.
• HR Neeti may transfer User’s Personal Information if we are acquired by or we acquire or merge with another company or transfer a part of our business, including the Software, to a third party. Any third party or resultant entity that receives the User’s Personal Information pursuant to a merger, demerger, amalgamation, reconstruction, change in control or business transfer shall have the right to continue to use User’s Personal Information. In the event of such a sale or transfer, we may notify the Users. If a change happens to our business, then the new owners may use your personal information in the same way as set out in this Privacy Policy.
• We may also share your personal information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies.

Notwithstanding anything mentioned hereinabove, we will neither be responsible for the actions or omissions of the parties (including but not limited to the entities listed above) with whom the Personal Information is shared or made available, nor will we be responsible and/or liable for any additional information User may choose to provide directly to any third party.

We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

You shall register on the Platform only if You are a person who can form legally binding contracts under Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, You may use the Platform or access content on the Platform only under the supervision and prior consent/ permission of a parent or legal guardian. If you are a legal entity, you may use the Platform only if you have necessary authorisation from such legal entity. You must not set up a User Account on behalf of another individual or entity unless you are authorized to do so.

 

11. Limitation of Liability

USER EXPRESSLY UNDERSTANDS AND AGREES THAT HR NEETI SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, INFORMATION, DETAILS OR OTHER INTANGIBLE LOSSES (EVEN IF HR NEETI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF THIS PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY HEREIN.

 

12. Governing Laws and Disputes

This Privacy Policy shall be construed and governed by the laws of India. Any dispute arising, between the User and HR Neeti shall be submitted to arbitration to be conducted in Pune, Maharashtra, India in English language, in accordance with the rules of Arbitration and Conciliation Act of 1996 (as amended from time to time), by a sole arbitrator, who shall be appointed by the Company and the award made in pursuance thereof shall be binding on the Users and HR Neeti. The dispute resolution and arbitration process mentioned in this section shall not prohibit parties from approaching the courts for appropriate interim reliefs. Parties further agree that the courts in Pune, Maharashtra, India shall have an exclusive jurisdiction over such disputes.

 

13. Communications and Time Limit to Respond

We will communicate with you through email, phone and notices posted on the Platform or through other means available through the service, including text and other forms of messaging. You may change your e-mail and contact preferences at any time by logging into the Administrator Account and changing your profile settings.

 

We try to respond to all legitimate requests within thirty (30) days.  Occasionally it may take us longer to process your request if it is particularly complex or if you have made multiple requests.  In this case, we will notify you and keep you updated on the status of your request(s). Our time required to closing requests that can be resolved will be notified within 30 days. 

 

14. Changes to Privacy Policy

By using the Site, you consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy and elsewhere on the Site. We reserve the right to make changes to this Privacy Policy from time to time which will automatically reflect on the website.
